1. Acceptance
By downloading, installing, or using Game World ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.
2. Description of Service
Game World is a collection of board, card, word, trivia, and memory games designed for blind, low-vision, and sighted players. The App offers both free and premium features through a subscription called "Gold Membership." Games may be added, changed, or removed over time.
3. Age Requirement
You must be at least 13 years old (or 16 years old if you are in the European Economic Area or United Kingdom) to create an account and use the App. By using the App, you represent that you meet this age requirement.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your account or use another person's account without permission. You are responsible for all activity that occurs under your account.
5. Gold Membership Subscription
- Gold Membership is available as a monthly or annual auto-renewing subscription.
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- You can manage and cancel subscriptions in your device's account settings (App Store or Google Play).
- No refunds are provided for partial subscription periods.
- If the App offers a free trial, any unused portion of the trial is forfeited when you purchase a subscription.
6. Virtual Currency
The App includes virtual currency ("Gems") earned through gameplay or rewarded video ads, and available for purchase as consumable in-app purchases. Gems have no real-world monetary value, are non-transferable, and are non-refundable.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to interfere with or disrupt the App's servers or networks.
- Use automated systems, bots, or scripts to interact with the App.
- Harass, abuse, or threaten other users.
- Exploit bugs, glitches, or unintended game mechanics for unfair advantage. If you discover a bug, please report it to support@appa11y.com.
- Create multiple accounts to evade bans, suspensions, or moderation actions.
- Impersonate other users, AppA11y staff, or computer opponents.
- Reverse engineer, decompile, or disassemble any part of the App.
8. User-Generated Content
The App allows you to send chat messages to other players and to post in community forums. By sending a message or posting content, you grant AppA11y a non-exclusive, royalty-free, worldwide license to store, display, and transmit that content as necessary to operate these features. We reserve the right to review, moderate, and remove content that violates these Terms or our community standards. You may report inappropriate messages or posts using the in-app reporting feature.
9. Account Termination
We may suspend or terminate your account at our discretion if you violate these Terms, engage in abusive behavior, or for any other reason with notice. You may delete your account at any time from the Settings screen in the App. Upon account deletion:
- Your personal data will be anonymized immediately.
- Active matches will be surrendered on your behalf.
- Your data will be permanently deleted after 30 days.
- Gems, achievements, and subscription benefits associated with your account will be lost.
- This action cannot be undone.
10. Intellectual Property
All content in the App — including graphics, audio, text, and code — is owned by or licensed to AppA11y and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App's content without our written permission.
11. Third-Party Services
The App relies on third-party services including Apple App Store, Google Play Store, Sign in with Apple, Google Sign-In, Firebase, AdMob, RevenueCat, Branch.io, and Expo. Your use of the App is also subject to the terms and policies of these services. We are not responsible for the practices of third-party services.
12. Apple & Google Third-Party Beneficiary
Apple Inc. and Google LLC are third-party beneficiaries of these Terms as they relate to your use of the App on their respective platforms. Upon your acceptance of these Terms, Apple and Google will have the right to enforce these Terms against you as third-party beneficiaries.
13. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure operation of the App.
14. Limitation of Liability
To the fullest extent permitted by law, AppA11y shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total aggregate liability for any claims arising from or related to the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.
15. Indemnification
You agree to indemnify, defend, and hold harmless AppA11y and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. If you are a consumer in the European Union, nothing in these Terms affects your mandatory consumer protection rights under the laws of your country of residence.
17. Dispute Resolution
If you have a dispute with us, you agree to first contact us at support@appa11y.com and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve the dispute informally, you and AppA11y agree to resolve any remaining dispute through binding individual arbitration under the rules of the American Arbitration Association, and not as a class, representative, or consolidated action. You and AppA11y each waive the right to a jury trial and the right to participate in a class action. This clause does not apply where prohibited by law, including for consumers in the European Union.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Changes to Terms
We may update these Terms at any time. We will notify you of material changes through the App or by updating the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the revised Terms.
